Bearing these files is a great responsibility and having them you risk your life and the life of your family being destroyed. Keep that in mind,sniffing vSRO site might also have consequences - you know what I mean,most likely.

Just out of curiousity, how can you family get destroyed? lol sounds like having server files is like having aids.

If it's running IIS 6, then it's vulnerable to a buffer overflow. But that's a big "if". What really matters is where you are trying to get the files. If you're attempting to exploit your way into a Joymax or affiliate server, then good luck. You won't get very far.

If it's a user hosted FTP (like a private server/etc), then you have a chance.

The thing is, these are highly valuable files. Joymax and everyone else knows that. They are NOT going to forget about security. Gonna take a lot more than a PHPShell to get that ****, trust me. And webdav? That's soooo 4 years ago.

Well I guess he mean that if you go in jail for some years and gotta pay a high amount of $ your family will be caring of you, if somebody i care of gets in jail i would be truly sad, i think thats pretty easy

Let's take an example that Joymax have found you and applied a free to pay the damage which is a total off 2,5 million dollars - what do you think - in case of your death - who will pay the rest? Obviously your family.

And well - in case the person who got sued already by joymax would like to suicide,his family will have to pay. I thought it's pretty obvious,isn't it ?

What are you talking about? 2.5 million dollars? Where did that figure come from? Prove your source.

When Joymax sued ecsRO, the total damages were only $75,000. Not 2.5 million.

Yea I remember a similar case now, someone people was involved in a shooting, then all but one took suicide and all charges were dropped on that guy.

ecSRO along with GoldSold.pl were sued by Joymax in California Central District court. Records are available online. And 2.5 million would be thrown out of court. Do you understand American law?

I understand. It's the risk you take.

However, the issue with Joymax is not posession of the files. In the United States, I could walk up to Joymax office in California, and tell them I have server files. They couldn't sue me or arrest me. I'm a free man. I didn't hack Joymax.

If I open a server for private use that does not allow "donations" or Silk to be purchased, then Joymax COULD file charges against me for using their copyrighted material. However, if I had the time and money for a lawyer, it would get thrown out of court since:

A.) I did not perform any illegal actions in obtaining the files.
B.) I did not use the files for a profit.
C.) Silkroad is technically a free game, so the revenue loss is a guess AT BEST.

No lawyer could prove that I was a result in lost profit from Joymax, UNLESS I SELL SILK. That's where private servers are going wrong. If you host a COMPLETELY free private server (free silk, etc) then you should be okay. If Joymax DOES sue you, then you must fight it in court. You also have to remember, private servers are most likely against the ToS set by Joymax. But if I do not accept the ToS, then they have nothing that will uphold in court.

There are a LOT of grey areas in American law, and some of it also depends on the judge. Most business cases such as this come down to statistics, copyrights, revenue loss and damages, etc.
