Actually, becuse a server doesnt charge donations (thus why they are called donations) and we dont ask for them or require you to donate to play they really have no standing. If they were to sue or try and shut you down they would actually have to prove that donating is required to get something in the game that you couldnt get without donating. Because most private servers (including Vengeance) donation items are able to be bought and sold by players to other players from the item mall they cant argue that it is to make you better or unattainable in game. Yes, its harder to get them, but you can easily prove that they are donations to help the server, not for personal gain.
As for blizzard cracking down, they arent cracking down on pservers. They are cracking down on people burning copies of the game, taking away the requirement of a CD key and reselling the burnt copies, and on people who are charging to play the game as a compulsory fee.
Remember: the word that means the most is COMPULSORY. Donations arent required for you to play so they are not a breach of the law. If you had items that you can only get in the item mall and cant be traded then yeah, thats a breach. But most servers now have a way around that even because they have items in game that give you DP.
The only way they can get you is if you have an account on Aeria that plays shaiya and is not banned (if its banned this does not apply) Because when you download the game you have to accept their ToS and in there it does say "You will not emulate this game or its contents or otherwise breach our copyright laws" However, if you are banned, have not been playing the server for over a year or have effectively deleted the game and its contents from your computer then you are TECHNICALLY not breaking their rules or copyright values.
The only thing i'm not so sure about is if you download OS to patch it to the private server.... however i believe thats one of those situations where its "how you take it" thats something that they could possibly get you for, but proving it would be hell and expensive because the server host doesnt use the OS client, they use server files which don't require you to click on a user agreement. So they would only be able to get the players and the amount they would be able to sue for would be around the$50 mark, personally, i dont think they would spend millions to sue tens of thousands of people for $50 each.... that seems like a bit of a stupid money loss move lol.
All and all servers are safe, as long as all your stuff is able to be gotten without the donation points (even if you have to buy it off donaters) then you're peachy. The moment payments becomes compulsory (if you have items that cannot be traded in your donation system or are completely unable to be gotten without donation) then you might have a bit of a snag and could be "in danger" of being attacked by them (which i severely doubt they would)
So make all your donation stuff able to be traded or dropped in game ^.^
