Lol this just seems all vague because if they indeed had a court order and you do in fact pay a monthly bill, you being a customer have rights to this service and someone has to be linked via email to the bills for contact info. So them or you claiming they don't have any contact emails to send a copy of this "so called" judicial order is very questionable and you should investigate it further..... think about it really.... and like I said before "EVO" ring a bell?????

im starting to think it was really a hack, and we are almost getting to sort out things with our server, please pray to us seriously, i swear we are not ******* it up with you, isnt a 'market thing', we are not dumb and we are sure we will lose loads of players with this thing... we would not get anything with this, only lose.
since i think all servers should be friendly with others and not treat like enemies, like we do today

in this situation, I say you call up the host and demand explanation, like others have said, stop payment immediately. call them nonstop until they explain the situation, the whole deal about "no contact info" is bullshit, they would have that if a legal notice had been filed.

Legal Speak.. Did some research and concluded.....

So are these private servers actually legal? The short answer is yes they are, however,
Aeria Games can considers these server to be against their Terms of Use Agreement. The issue that Aeria Games faces is proving that the owners/operators of these servers are subject to Aeria Terms of Use. Some of you if not all of you remember someone on this epvpers forum broke down Aerias Terms of use and showed a private server does not violate it. Also a private sever that charges to play is illegal but if it runs on donations its totally legal.. even if they remodel the map and add another world to the map and YOU download the patch.. its not illegal.

seriously, if someone hacked us, please be aware, i will screw your *** off... sorry the bad words, but i had to say this here, so would be public, and im serious.
we can't give anything for sure, but i think this will be only a matter of time, nothing will be lost, **** aeria, **** hackers, **** them, we always plaid well, never advertised in another server, we haven't been using script on top sites like some other servers, and always tried to be friend with other servers owners, its pretty unfair this.

Thankyou for the warning guys and wish you a speedy resolution to this un-neccessary malicous drama(like Shaiya needs more drama)

I will make a suggestion to players and this should be the case for all anyway, always use different passwords/account names on each server. the accounts could be compromised on 1 server and give 3rd partys access to all your accounts on other servers.

Here is the way it is.
Yes, AGE leases the rights to Shaiya from ChoiRock (formerly Sonov) who owns the game.
AGE has an agreement with ChoiRock for proprietary rights to the game. ChoiRock makes money from AGE leasing the game.
Private servers are stolen copies of the game. They pay ChoiRock no money for their product. They have no right to use this product or distribute it or market it in any way. This is why legal action can be taken against private servers, they are dealing in stolen goods.
Thievery is still a crime in most parts of the world that I know of. You steal, you get caught and you get punished. (Do they still cut off a hand in India for stealing?)
First step of punishment is closing down the ILLEGAL copies of the game. Your host would not have shut you down without the previously mentioned court documents. Those documents are not issued on a whim, there has to be proof presented before a judge will make a ruling on the matter. Proof. Interesting concept. Which one of the people you have been playing with is actually part of the prosecution team for AGE
Second step is to pursue criminal action against those who created the PS
Third step is often civil action for compensation for monetary damages.
Hope the 'donations' you have received will pay for a really really good lawyer - 2 actually because criminal and civil law are 2 very separate areas.

The only people that can even begin to take action is Choi Rock games, they are making tons of money on the games they have created. I doubt they will waste their time with the handful of private servers we have. Aeria games does not own the game, just the content. I am pretty well 60% percent sure that most new private servers do NOT associate with content from AGE. If they however use their client/item mall / etc... Then age will have rights to then act, cause that is their property/creation.

In all... i dont believe choi rock is responsible for this.. but I had a nice laugh at your scare tactics allsomisinformed. We can all read laws of our countries and our rights same as theirs... lol

It is quite unfair... I hope everything works out and quickly. If it was me I would have them try to fix this within next few days, or leave host entirely... it could be a scam from them trying to get more money.. like others have suggested. Either way its horrible situation..

Its highly unlikly there will be any civil suit because that is going to be a costly affair for aeria or sonov to even begin to file a cross border suit. Before that they dont even know who they are dealing with nor who the actual owner of the server is. If its all in the US then its awhole diffrent ballgame but I doubt thats the case. In the civilized world you cant really sue for just anything. In america you can sue the microwave company because it sucks for drying your cat and theres no label saying you cant put your cat in there.

Anyway im sure Rebirth will be back in bussiness soon enough

Lets put it in perspective. The money it would cost to take just ONE private server to court is over a million dollars. That is a hell of a lot of money, even for a corporation that makes billions bcause they still have to pay SONO/Choi and any other companies that lease their games to them. IF AGE had even the rights to take anyone to court that's a **** load of their profits for just ONE private server, now if its 5 servers then they would be spending 5 million dollars. and thats only the least they would spend.

As they wold be taking you to court, they have to pay, lawyers, copyright, any documents they need to pay for, booking and other stuff. All and all it adds up to around the million dollar mark.

We make a hell of a lot less money than they are and the % they loose to us would be in the 0.01% margin. So try to scare us again about this being a REAL lawsuit allsomisinformed..... The point to them taking anyone to court is minimal and they would gain very little, what are they going to do? take away the server and the 500 bucks we make a month for it? that's petty cash to them o.o

Maybe try getting those facts straight and reading the laws. Private servers arent stealing; larceny: the act of taking something from someone unlawfully. Because the game is leased to AGE aw arent stealing from them, and because of the new laws passed in the US making a private server that DOES NOT run off a p2p system is completely lawful.

However, if you were to charge a fee to play the game then there would be a reason for them to sue.... but i still doubt they would and also, no one would play the server anyway lol.

Please, before you post and look stupid, read the laws of the country that the server is based in. Because Rebirth is based in the US they are completely within their rights. So please alsomisinformed dont kill anymore of my brain cells.... Read the law, its quite clear. Reverse engineering (which is what shaiya private servers do, it has a bunch of different names) is protected by US law.
