A reguler server is any of the darkorbit servers. A private server is a private one, created by someone else who is not a darkorbit developer.

I think publish it on a US or Israel server And make it public because in these country's they have Fair Use Law and Fair Dealing ;

While many other countries recognize similar exceptions to copyright, only the United States and Israel fully recognize the concept of fair use

this concept runs by 4 basic rules they look at and there is another way to use it in defence : Parody in some country it's legal to make a parody of it.
and the code's and stuff is not bigpoints but yours / everybody's skill and you can't ask Copyright on ideas ( so the gameplay/space game) only on inventions/stuff.
so i think you should be able to have this public as long as you

-Make No Profit / dontations sry.. but you can ask it for something else like for making a thread xD and we all know what it would be for but it must be free to join and no adds / donations.
- Use somehow something educational / testing / reviewing you have the right to use copyright protected things on a certain level for educational purpose or reviewing / commenting.
- You can also use parody as defence make some funny things many credits out a alien for example or whatever and that would make it kinda parody alike.
- use a many non copyrighted images or edit them very litle, i also heard most old image of the new client in 2011 have no copyright anymore but the oldest ones didn't anymore already like blue goliath old vengeances etc
and like this there is many more tricks/cheats to make it very hard for BP to sue you.

(PS look for example some projects like Black galaxy only they use difrent graphics but same game play , and Darkorbit Protegit / Pimp my ship (.fr) they use a little game play/testing and some fan made stuff as excuse but do have the graphics ,see the idea? combine gamplay and graphics is legal like that if its separated legal as well )

i have a question, did u copy darkorbit code, and added a few thinks so that u can conect etc, or u just made a darkorbit clone witch looks like dark orbit(no like other darkorbit clones witch look like another game)

The game client itself is copied(swf files) but he has programmed the server with VB.

Copyright notice will foreclose any attempt of publishing this game. However, it is a very impressive work and I like it. Though to be honest I don't understand why do it. Beside the reason that BP SUCKS.
