I'll keep this short. Private Servers are a no-no. Due to Barunson Game's (the game developers) Terms and Conditions, they have the right to sue anyone apart from Aeria who owns a Last Chaos Server. AFAIK they're suing EterniaGames for over $220,000 right now.
Aeria are the only company who has a unique licence and can run a Last Chaos server, and that will uphold until 2012, so all Private Servers will be illegal until when that expires (which Aeria will obviously renew...)
Where did I get this information from? Emailing the developers (Barunson Games) to see if I can purchase a legal licence myself, but now no need...
