Do you think TQ really care about a tiny bit of trademark infringement? Do you think they care that you're mirroring their client that's already free to download?

No, they don't. They care about the private server that's taking money out of their pocket.

The problem is they can't do you for that, since it's not illegal. So they'll send you a big scary letter about all the things they COULD do you for if they wanted to, in order to scare you into shutting down the pserver.

Since the majority of private servers are run by kids (no offence guys!) TQ knows that when they send out these letters 90% of them will just crap their pants and shut everything down.

The only ones that remain are the ones that are smart enough not to break the law.

If you receive a letter from TQ about law violation, co-operate with it. Remove all offending elements of your website and inform them that you have complied. Request that they check the site and explicitly detail any remaining elements that they believe violate their legal rights so that you can remove them.

They can't demand that you stop providing an interface that allows players to connect modified clients to your server. They can't demand that you stop linking to another website which links to a torrent for downloading a modified client. They have no legal standing to do these things.

Remember kids - breaking the law is dumb. Don't do it

No i am not inciting an arguement. I am pointing out the errors in your post, because you took apparent offence at the comment about TQ giving you a server, not about me hoping you are closed too.

I guess Geography isn't taught wherever you went to school, considering Europe is a Continent and UK is a country within that continent.

You claim to be a law researcher if I remember correctly when the way you put your points across on this forum is the way a 13-15year old would.

You are just upset that where you played was shut down by TQ and others weren't now all that time you wasted is clearly a waste of time. Not our fault your server gave up so easily so don't take it out on others ok.

If we don't host the client we are distributing the software.
We run a autopatch program writen by forcer and a play.exe written by forcer how people chose to use these are up to them.
We only host self extracting files with files that happen to have the same layout as files used by Eudemons Online, again the use of these are the choice of those that chose to download them.
Would Nero be sued for copied DVDs? No because they only make the software available for it they do not make people burn illegally.

This was discussed when ACME was first started that they will not be as easily shut down due to location go back and read old threads it was suggested you look into hosts in these kinds of areas.
It was also discussed hosting it in the States or a country associated with the states in such ways would be enough for them to shut you down easily enough.

would u risk and try what u sayd to cooperate with them?
and yes most of the servers are run by kids or teenagers so many or all of them cant afford to go to trial and court so its mostly obvious then most or all of them will close the server

What risk? Their legal threat demands that you take down the offending content and contact them about your compliance.

You simply do what they demand.

On a risk scale, I think doing exactly what they ask you to do is a safer bet than ******** yourself and running away.

I'm not sure if any of the people contacted by the lawyers did as the letter asks and contacted them in writing to confirm their compliance or whether they just turned everything off and went to hide somewhere, but the letter asks you to contact them about your compliance.

At no point does the letter even mention the private server, let alone ask you to cease it's operation. It asks you to cease doing some very specific illegal things and all you have to do is comply with the request.

YouTube doesn't shut down every time someone uploads a TV show. You don't have to shut down a private server just because you were dumb enough to use trademarked content on the homepage.

As Phantom said most servers are run by teenagers who dont have the money u have and they accept donations only to keep their server on...and not to be rich as u do in ACME.....
and if TQ wanna close the pservers...i am 1000000000000000% sure they will lose a lot of players.....

Wait, so other servers are run by kids so they need donations to keep them running.

But because ACME is run by smart people, it is some how magic and free and requires no donations to run?

I wish I was as smart as you think we are. I want to be able to make magic free hardware!

Last time I checked there isn't some sort of extra tax that kids get when they set up game servers that makes it suddenly more expensive for them.

ACME is actually considerably more expensive to run 'cause we're not running it off some crappy home PC on a DSL connection.

i bought the server hardware and pay the host..
which all in all costed about 3500 usd for the hardware (which i still havent got back from donations)

i hope that covers the rumour that acme is getting rich.. if acme is shut down now i will still be at minus on my account...

How much do you think people actually donate to a private server? Seriously?

It certainly sounds to me like YOU'RE making lots of money out of your server, even if the rest of us aren't.

I don't know quite how much you're making off your private server, but we sure as hell haven't made anywhere near $3500.

Oh, and I'm assuming you are running a private server that's making more than that. Because if you're not that just makes you some dumbass who doesn't know wtf they're talking about.
