I'm getting a bit bored of reading posts saying that private servers, which use the original DarkOrbit client are perfectly legal as long as no one charges for items etc.
This is false information.
If the client at any point is hosted on a publicly accessible server* other than one which is owned or endorsed by BigPoint then you are immediately in breach of BigPoint's copyright. In fact, it'd be several cases of copyright infringement because it would be one for the images, one for the code, the sounds and so on.
*Note that a publicly accessible server is anything on the world wide web. It doesn't matter if it's only for "trusted members", it'd still be publicly accessible with the right abilities as the server would have to be connected to the internet (which we all have access to).
On top of that, the same copyrighted material would have been used to boost the administrators publicity, traffic to websites etc. Which I believe is also against a trading law somewhere.
The amount of money that it would cost to keep a full private server online is through the roof. This means that unless the administrator has a bottomless pit of money, they would HAVE to bring in some sort of income from the service. Even if this was in the form of donations, advertisements etc. this would all be "damages" that BigPoint could easily claim back. Let alone the "damages" that would be claimed for the loss of revenue.
So no, it is not legal no matter what way you look at it.
This is where anyone who is creating a private server always gets stuck. The only real way forward to a private server is actually to create an entirely new game (both client and server) based upon the same ideas that DarkOrbit uses.
TO -JD-: I'm not trying to ruin your party or anything, I'm in exactly the same position as yourself. A solution really needs to be found.
