As long as you do not distribute any files from the client itself (and this includes things like an updated gamemap.dat to link your new map) then there is not a problem with it.
Your auto patcher would need to do the work itself (such as running a minor script to add a new entry to the client side files). This, I believe, gets around the issue because you are distributing your own program that patches in your own (fully custom) images, text documents and entries to certain files. If you are distributing anything created by tq in your patches or autopatch client then yes, there will be issues.
Correct me if I'm wrong though.
That being said.. I still don't see why this is even an argument. All private servers you run in a practical and public way will be illegal unless you have some form of agreement with the original game.
