Look at Qonquer,It has been up how many years ?? And before markus took it over and made it gay by selling TQ items for $$ it used to be free to play 100% nothing could be bought ingame for cash and tq hasn't given it a seconds thought or even tried to shut it down that i'm aware of and uses a unique self coded sourcecode.

All the above servers listed didn't code anything they downloaded copyrighted binary and client and are trying to sell items for money to line there pockets based on copyrighted material and deserve whatever they get.

The people that run a server 100% free with disclaimer i wouldn't worry about it because your "using" tq material which is freely downloadable in a non profit environment there is really no breach of copypright there is nothing in users agreement that says you cannot use there client freely as you wish and run a server using that client as long as your not claiming it is yours and or making money in a fraudulent way off TQ's products.

It is the same reason why some EO servers got shut down yet others have flurished untouched and it the ones attempting to make profit off the servers that have been shut down,So like i have said before to people quit being stupid trying to run Co servers for profit.
1: We Dont gain any attention cuz Egypt dosent on the ruls of the private server

2nd : Shery Gm On Tq Test Our Server And She didnt Say Nothing To Us

3: Uzn Will Be Off Soon Cuz It gain attention That is what i see

Allow me to clarify that I meant that TQ would threaten a lawsuit to get a server to shut down; they would never actually follow up on it, as a previous poster was right, they wouldn't get anything but a hole in their pocket.

The user agreement for TQ states you cannot use any of their clients for anything except connecting to their servers/services.

Well how TQ wanna stop me or other Private severs ?!

Shut down the site on my hoster lol **** for it i just host it by my self or change the web host.

Well where i live piracy is allowed and the cops will smile if someone comes and say Jimmy broke our copyrights please help us to court him.

The thing you fail to realize, however, is very clear.

You agree to that terms of service when you sign up for an account, am I wrong?

All that can happen is they have the right, since you broke their terms of service, to void your account. That's it.
You never, EVER, agree to those terms for any other reason. Thus, they can only void your accounts that you made, nothing more, nothing less.

although this is not on the topic of co but tq games they do not do anything till someone makes them i own ... or well used to own a eo private server and just a few days ago we were given a letter from netdragons lawyer telling us we had 10 days to close our server so just watch out about that they did use the client as a way to get us. all this happed to my server because ip baned someone who thought they could hack my server and failed then chose to go to tq instated ... some may say we could have fought that one but it wasn't mine or the co owners name being sued but a good friend who was hosting our site for us

Yes, they make sure you agree to it all upon registering. But a link to the agreement is found on the bottom of their website and almost all, if not all web pages. So wouldn't you have to follow it upon entering their site? :/

And in every 'original' client install, there is a file indicating: "copyright TQ Digital". Now, there is a "2003" date in it; but I'd imagine they have updated that copyright, considering it's in their license/user agreement and it's all updated to 2009.

And, based on the agreement, it's not just loss of your account(s). They also include: "This Agreement is governed by and shall be construed and enforced under the laws of the State of California".

But, hey, the client might not be updated, making my entire argument wrong.

At no point do they mention 'you must agree to our terms of service by using this site', nowhere does it say that. They also do not mention that use of the site auto-binds you to that terms of service.

A copyright is only disallowing modification of the client, or modified redistribution. However, they do not ever say, in a terms of service using the client agrees to, that you cannot redistribute the client.

I don't know the laws of Cali, but again: you do NOT agree to those terms unless you make an account.
