You're misunderstanding something, first, I doubt that you can create a source out of the binaries and second, it is effectively impossible to make a high patch server using the current binaries.
Now as to why it is illegal, they are warez which is also why e*PvP disallows them. You might ask why the EO/Zero bins are allowed; no clue.

binaries are hacked files from tq's host. by the way if u want run a pserver from binaries, the community will lose any respect to u, u can't make big edits to ur server and we learnt from Ultimation that binary servers are easy to crash(since he maded programs for that ) so there aren't reasons to run them.

as it would be too hard to HEX msg game server as C# is widely opened
a small example if u wanna raise nobility or No. of kings,prince etc... Simply u do that in a class file with just changing the value
if u wanna to do so in binaries it would worse a **** of work if u r not experinced enough

Love2Hate is a bins server currently, which kinda destroys most of those arguements, although i dont personally agree with binaries Janix can do some remarkable things with them.

even though you don`t have full control, you have like 70% control on the gameserver
can use it as reference for your personal custom server along with the eo source files
i dont give a **** about the cyber-respect
your c# server is as highly illegal as the bin server since you use their client that your distribute over the web. they cant sue you for your server since they cant just open up your dedi and say "lets take a look". that`s private stuff and they have no right to do that but instead, they can do a lot "damage" for sueing you for distributing their copyrighted client. either way, you`re ******, with or without bins running.
there are only two people in this co community that has some worthy bins to use. one of them is richie... and the other one prefers to remain anonymous but however, their bins **** on your c# source what so ever.

The eud binary source is a fantastic resource.

I've seen multiple (VERY impressive) C# sources for conquer written using the binary source code.

Obviously not your argument but there are plenty of "sources out of binaries". They are some of the best sources you will ever see because they emulate the server perfectly because well... they ARE the server. Obviously improvements still get to be made but still, very good sources.

Dev Co is some sexy stuff (if you can bare to read through all the TQ labeling of stuff)

That's why you let people download it from TQ's servers and provide patches to make it work (loaders etc.)

Indeed, if you can keep up with the lastest CO version, yes, you can provide directly the link from their website and you'll avoid the copyright/trademark infringement. If you cannot, well, you can be sued but considering the amount of money private servers make within a month, and the amount of money TQ makes within a month, it makes the private servers look like a meaningless bug. Obviously, they don't lack of players and we all know TQ is a moneyhunger company so yes, it's all about the money.
