AGE doesn't have the right to take down servers or serve injunctions of any type about it. If, people were asking for a fee to play the server then thats a little different. Running off a donation system is legal and by right, they actually can't try to scare servers.
I personally wouldnt go sueing them because they would win, they would find a loophole in it and on the servers part it would cost thousands, perhaps tens of thousands to sue them.
On the topic of what is legal and not, i as doing some reading and it comes to these simple rules:
1. Server emulation/reverse engineering is protected by law in these countries: USA, Australia, New Zealand, Asia. (Europe has very lax copyright laws too so they're pretty protected)
2. Burning and selling copies of games such as WoW, Aion, Guild Wars and other games that are sold in stores and creating CD Keys or making the system not require them IS ILLEGAL.
3. Asking for a compulsary fee on any game that is considered private and that you are releasing out of your own personal reasons is in fact ILLEGAL. (So dont charge a fee for any private servers pretty much)
Thats pretty much the short version of what i read. Bear in mind that different countries will have different interpretations of this and may be more in depth. But an article was released about it being ammended mid september last year and thats a summation of what it said.
