Bob tries the argument that they agreed to confidentiality and that all this evidence obtained from his house is in-admissible (not valid)
The Judge laughs
The Judge then explains the rights of a contact etc, a prime example is this sign, the police officer for 1 could say it was poorly placed and did not read it.
Also this sign does not make him excempt of the law as your "page" does nothing for you.

If it were bought up about TQ agreeing at your site they could argue even if you were able to counter sue them that, 1 you did not have a disagree option, 2 they did not read your site they merely navicated it to obtain a client, 3 they were given this link:

Just like everyone's "I Agree/Disagree" pages they do not stop outsiders bypassing that page all together. Just like the sign does not stop the police getting into Bob's house.

Let me show you something.

1. I dare you to click that link and tell me what it gives you. A 404 error. AKA Page does not exist.
A. Ok so that kills navigating to the website without accessing the disclaimer page.

2. They will just get on the network with the pass somewhere else.
A. Quote: "3. You agree not to inform any member, associate, owner, operator, or any other affiliated member of TQ Entertainment of this content or the products provided by WebRPGDesign Demi-Flame Project Division. Including but not limited to how to access the network."

3. They will just read the pass on the site.
A. Then they have to read through it AND click agree. They would then have to delete any evidence.

4. Its a sign saying stay away.
A. Its not just a sign saying you have to do this. Its a sign saying if you don't agree to this and continue to the network you are breaking the law.

But to show to you what i mean i will critique everything you said. My responses will be in parenthesis.

(In cyberland it actually means something, and when asked to apply an electronic signature and you do it is legally binding. Look it up.)

(Wheres the search warrant? Cops lose in court, broke a law BREAKING AND ENTERING WITHOUT A SEARCH WARRANT IS I L L E G A L)

The site is not online on the internet it is on a private network. So only those with a password can access it.

Dude go learn something about a contract. You can not sign a contract with someone that if they were to break the terms you are allowed to punish them in ANY way. This would still be limited by the law. Your argument still fails because even IF your TOS agreement was valid then people from your server can easily post links in public forums for your client etc or information. This can then be obtained by TQ sadly when it's someone being prosecuted they do not have to prove they did not do it. The prosecution only has to fail at proving you did do it. darklord3601 is correct, they most probably not bother with the servers that don't have an option for donations but every company is unpredictable if they have a private server on the brain so don't think that all the non-donatable-to servers won't be shutdown because it is very possible.

This thread should be locked, it says PETITION but there is no information in the post about a petition.

Nope, TOS says members who agree to the terms CANT POST LINKS. Conditional contracts, look at a phone contract. YOU CAN PUNISH SOMEONE FOR BREAKING A CONTRACT! Removal of possessed data is a lawful condition of a contract, read a EULA. In the event a member posts a public link it will become a "by-proxy" lawsuit. Lawsuit resulting from a lawsuit. Member will be sued for loss and damages. Again LINK MEANS NOTHING IT IS ON AN ENCRYPTED NETWORK AKA NOT PUBLIC! There is a disclaimer on the network that displays informing members if they are a member or affiliate of TQ or netdragon they are not authorized to be on the network and must leave. I am starting to wonder how much you know about the laws in the USA...

and just a fast question.

If someone posted a link somewhere so that TQ can visit your site. how are YOU gonna find this person and drag said person to court? seeing ppl play eo from all over the world. and either way you're using a client that you signed your own TOS to use. so you allready broke a contract yourself. even if you didnt take tq's client straight from them i assume you did play tqeo and there is the tos.

yet again. im not sure about this. laws in sweden are diffrent than the ones in the states

The funny thing about the law is it depends where it was broken but then electronic violations depend on the prosecutor too as you will have to comply to that countries laws aswell (if deported). But my point is not that you can sue the person that gave out links etc my point is your "TOS" does NOT make you exempt from the law in ANY country thus IF TQ wanted to take you to court they WILL and they WILL WIN. No matter what you say, but again my point aswell is TQ does NOT care it is not worth their money. How many active players actually play pservers close to maybe 3-5 thousand? How many play official TQ servers, that number I couldn't even begin to guess considering Chinese EO is bigger then WoW (over a 100 or so servers with peaks of 600+ players) there and being that China is 1/2 the world's population they would sure make enough from there. I remember reading an article about how in a couple years TQ went from being a low muli-million dollar corporation (share-market value) to a multi billion dollar corporation (this is off memory but I am pretty sure that's right). During the interview aswell they commented on what the key to their success was they said "Gems" something rare nice looking status binding (the jones' effect) and the advantage in game.
