They could just use it again, no one is willing to go through the hassle of suing, possibly losing and ending up having not to only pay his own lawyer costs, but arenanet's too. There is nothing really stopping them from using it except for moral reasons.
Now, I mean, against this behaviour, it'll be always possible a Class Action ;) or at least I hope so; it is only necessary that a sufficient number of users agree to divide the costs, in the case of another event of this kind.
For example, if even half of the banned users were willing to spend 14€ in legal fees, the total would have been 10,500E, that's enough to worry Arenanet and warns them against a "certain type" of actions in the future.
