The code was available CONDITIONALLY, and that condition was not met, meaning the only person stealing code is that person who doesn't release the source to a derivative.
It's like me saying "i'll let you drive my car if you agree to fill up the gas tank before you come home". We have an agreement, you can drive my car for whatever you need, but you have to fill up the gas tank before you come home. Now what PAX has done is essentially taken the car, driven it until it's running on fumes, then returned it without filling up the tank, like was agreed in the beginning. Then he says "you're just trying to steal my money asshole."
