I don't think its worth releasing a private server unless you decide to customize a majority of the game elements.

As to the original question, a Mabinogi private server would definitely "succeed". However, if the server generates even a modest amount of interest (and you haven't modified the game at all) you most definitely will find yourself on the wrong end of a lawsuit.

And what's fun about a server that's exactly the same as the original but comes with lag and high stat rates? If you're really planning on going through the effort of releasing a "PRIVATE" server, wouldn't it be more interesting to implement as much originality and ideas you can to the same boring game we've had for years?

Matter of taste, not everybody wants a highly customized server. Maybe one simply want to get away from Nexon. Or maybe a noob would rather be total 5000 in a day, after failing on the original game for years, without loosing the original game. Or maybe people from different countries want to play on the same servers, without proxies. Of course some people want to see new stuff, but that's not a p-server's only right to exist. And btw... lag? Maybe you've had bad experiences with people hosting servers from their home PC with Hamachi and stuff, but a good p-server usually lags much less than the overfilled official ones.

Customizing it won't help anything. Actually, if you provide modified official client files, for your customizations, you're especially screwed.

Rapid levelling isn't worth the potential risks imo

A good pserver without lag needs a way to support itself. The people running it can accomplish that by either taking donations or putting up ads. However, the only way to get a significant amount of donations or attract bigger companies is by generating a lot of traffic (attention).

By modifying I meant actually creating new game elements. Maybe I should've phrased it a different way

And why would modifying client files be worse than just using them? I'm not a mod expert but I'm certain that at least some of the mods on this forum MODify client files (isn't that why they're called mods? i'm not sure)

So? That doesn't change what I said o.o And it's either small and you don't need a lot or any money from players at all, if you're willing to pay for 1-2 servers, or it's getting bigger, and there won't be much of a problem to get some money out of it. Although making big money out of it is another big problem of course.

Because you're violating Nexon's copyright, if you provide mods, or any client files at all. Nexon might ignore the simple visual mods people are using, but that's the easiest way for them to get you. If you're only operating a server, without using or providing any client files, you're simply running a game service that is an exact copy, and they have to make use of other laws.

Which was what I meant. It's impossible to have a lag free server + lots of players while staying under the radar.

I see where you're getting at

I always thought it was easier to avoid copyright infringement charges if you modified the original file (like those people who keep licensed videos up on youtube by mirroring them, adding subtitles, etc). But in the end it'd be all the same =\
