You really don't need to worry about making a new private server. There are tooons of them on the internetz. And only 2 or 4 got hunted down by the fbi.

illegal or not you can still take measures to stop yourself been hunted down i.e: HIDE YOUR !*@#$ IP ADDRESS >.<
