Take action on what? You don't own it. Plas made it when he didn't have a company and he never contractually transferred rights to you. You have no proof you made it. Everything on that website except two things were done by others. The things you did look so shit its stupid. You need the psd documents to prove you made it for your copyright to be in effect plus i'm outside your country.
