[info]DMCA/FUP what is it

hey all
basicly i shoulnd post it here as it can solve a lot of problems but on the other side i want to prevent abusing of the abuse system

first of all , lets explain what DMCA is

dmca is Digital Millennium Copyright Act

it just means that if you do something illigal and it have to do with digital (like the server) then they can use it to sue you

but on the other side , like all rules does it have rules to
not every DMCA is valid , it is not that they say that it is illigal that it is realy illigal

same as the way they say it , it need to be valid before it can count

and that is where i wanted to show you

as a lot of us got a email from some1 (i do not call names :P but i am dealing with them for 1.5 years now) that claims that you are abusing there files

so take a look at [Only registered and activated users can see links. Click Here To Register...] to get a explanation what they exact need before a dmca is valid

then you will notice that there dmca complains are 100% invalid because a lot of missing information

hopely this can help you to understand when you need to worry and when not

then there is a other nice rule that only a few know about

FUP or Fair Use Policy (Fair use - Wikipedia, the free encyclopedia )

FUP basicly means in a short way , you can use copyright protected work as long you do not make profit with it or that you start to abuse there names or that you harm them on any other way (making promotion with there name to gain players is abusing it )

so you are basicly 100% safe and they can do a thing to you as long you keep on the FUP and as long they keep sending invalid dmca complains

hopely this can help you to fight against the fake abuse complains

dmca means that you are violating a copyright (included but not limited to websites and other digital information)

it is basicly to protect the creator that there work can be abused/stolen

problem and reason why i want to post it here is because a certain law office is abusing the system by sending invalid dmca complains

they force you to shutdown when they got nothing to say, they are sending those complains in the name of NetDragon when they never provided permision to them

they are trying to shut down every private server (got 300+ emails of it and again 150+ emails from my datacenter of it ) but until now they still not suceeded

because i want to start a fight against that company is it only possible if they can get eliminated so they do not suceed in it anymore

for that reason i released it here , so you can reffer your datacenter to this post if they are complaining and on this way is it even possible to eliminate fake abuse complains

basicly i give this information so your private server got more change to survive , as most servers goes down after 1 - 3 emails of them

the most users are affraid to get sued by them , and a datacenter takes action against all abuse complains they get

but if a dmca complain is not valid then they will never win a court as they got invalid information

so to make it short
if they send a invalid dmca complain then you are safe to use it and the fun part of it
you can sue them for using fake information (sue the laywer :D )

on that way i hope that they finaly can stop sending those emails to me and my datacenter and other users who try to do something good and to prevent abusing of the abuse system

or to explain it easy
if you know how to protect yourself then you are safe and do you know when you are in danger and when they are just trying to shut you down

at this point i am pointing to a law office that shutted down a lot of private servers by sending non valid complains (they tryed to shut down 95% of my clients ... )

so the only way to protect from them and let them stop sending those emails is to release the information to the public that they are abusing the system

on 1 side i lose clients because of it , on the other side i get hopely rid of those fake dmca complains

so to make it short
enjoy reading and start using it (fight the fake abuse complains)
or just ignore it and don't complain that they bring you down with fake abuse complains

then to answer your question
wesites have copyright to , and if they can provide a valid dmca complain (proof that it is there website) then nothing can be done against it
but as long they do not provide the needed information then you can keep using it

or you can use it if it is valid of FUP (websites mostly does not count for it as it got to mutch things that are copyright protected and cant be used for FUP)

fup only counts if you use parts of there work for non profit
not that you use all there work (private server is own work with there basic work)
