SEGA and Gearbox face Lawsuit over misleading Trailer

The video game developers "SEGA" and "Gearbox" are facing a group action lawsuit in the USA, which was brought due to a trailer of the game "Aliens: Colonial Marines". According to plaintiff Damion Perrine, he fell victim to trailer fraud:

"Each of the 'actual gameplay' demonstrations purported to show consumers exactly what they would be buying: a cutting edge video game with very specific features and qualities. Unfortunately for their fans, Defendants never told anyone — consumers, industry critics, reviewers, or reporters — that their 'actual gameplay' demonstration advertising campaign bore little resemblance to the retail product that would eventually be sold to a large community of unwitting purchasers," states Damion in an extract of his claim.

Mentioned game has already attracted attention to many interested people with help of the trailer. Most of them were left bitterly disappointed with their purchase in the end. Unfortunately, it was not possible, to get a glimpse of the game in form of a review, as a review ban was spoken out until its official release.

i checked the trailer & gameplay videos... i dont see the problem

It was about time. A game trailer should either be a promotional video, like the intro of the game, or actual footage of the gameplay. Or even a mixture of both. But under no circumstances artificially enchanced (visuals) gameplay that has little to do with the actual game experience.

It's a cinematic trailer. It is the purchaser's responsibility to look-up the gameplay video. Do the final fantasy realm reborn and arche age and guild wars 2 and planetside 2 and star citizen trailers resemble the actual gameplay? Of course not! They are CINEMATIC trailers.

The Alien-guys are most-likely being sued by a competitor-company.

Since WHEN has ANYONE cared about consumers being ripped-off? They are -I would hypothesize - infringing on some other FPS company's control on the FPS-industry.
