When calling a cheat provider legit, we need to look for those with an overall positive reputation,
transparent information (clear communication on a product detection), responsive customer support, high-quality and regularly updated products, and a clear refund policy (Whether it is provided or not, it has to be clearly stated).
Conversely, scam providers will have negative reviews, lack transparency, offer poor customer support, provide low-quality cheats that frequently get detected, have security concerns like malware, and will have no clear communications on their refund options (if any. Again, there should be a clear communication this pre-purchase so the buyer is aware).
In the case of a product that frequently gets detected, if the owners are putting in the effort to communicate this with their users, in my opinion, this provider should be listed as a legit provider given that they check out the other tick boxes mentioned above. It would go a long way to have them on the list and switch their status to UD/DTC as time goes on, and if there is a pattern on detection perhaps adding a note on the side with a "Frequently Detected"
I hope my input helps both parties above that are in a disagreement.
