It won't make any effect because there will not be an open registration, so not everyone can join... That is actually the right thing for a term called Private server!

I would love it soooo much to be a tester :) This is just amazing, I thought it would take a lot of time for like a few months before first tests but dude, A-M-A-Z-I-N-G!

Bigpoint will not report the server,if jD don't make uridium with money or premium with money,jD said Premium will be with uridium.

So , what i have to do guys to join to server ? What make me sure that jd will read all these messages and make accounts for all of us ? is to much work ; i don.t know what to say just leave a message.

This is false information.

If the client at any point is hosted on a publicly accessible server* other than one which is owned or endorsed by BigPoint then you are immediately in breach of BigPoint's copyright. In fact, it'd be several cases of copyright infringement because it would be one for the images, one for the code, the sounds and so on.

*Note that a publicly accessible server is anything on the world wide web. It doesn't matter if it's only for "trusted members", it'd still be publicly accessible with the right abilities as the server would have to be connected to the internet (which we all have access to).

On top of that, the same copyrighted material would have been used to boost the administrators publicity, traffic to websites etc. Which I believe is also against a trading law somewhere.

The amount of money that it would cost to keep a full private server online is through the roof. This means that unless the administrator has a bottomless pit of money, they would HAVE to bring in some sort of income from the service. Even if this was in the form of donations, advertisements etc. this would all be "damages" that BigPoint could easily claim back. Let alone the "damages" that would be claimed for the loss of revenue.

So no, it is not legal no matter what way you look at it.

This is where anyone who is creating a private server always gets stuck. The only real way forward to a private server is actually to create an entirely new game (both client and server) based upon the same ideas that DarkOrbit uses.

TO -JD-: I'm not trying to ruin your party or anything, I'm in exactly the same position as yourself. A solution really needs to be found.

Actually, your wrong. Copyrighted content that is digital expires after a year of not being used. This means that as long as I stay under the 5% of "copyrighted digital content" that is allowed as a "sample" then I am not committing a crime. Also, copyright in most cases applies to the distribution of content FOR MONEY.

The code is actually way way different, and the fact they use an obfuscator for their public facing code means that it is even more different. If you run a Diff on decompiled code, it says they are 1% simillar. Thats code copyright out of the picture

Sounds, well, sure there are some similar sounds, but hey! DarkOrbit changed all them too! Lasers, Aliens, gate jumping etc are all different!

Images you could argue... however I am trying to avoid this issue as much as possible! You could argue that me uploading a Private server with DarkOrbits images in it is EXACTLY the same as uploading a Youtube video of me playing the game. Where are the lines drawn?

I can't understand. Knight Online, Silkroad and a lot game have pvp servers. Moreover they are selling items with money. But BP is a huge shit dude. They need to give us permission for this..
