Do you think TQ really care about a tiny bit of trademark infringement? Do you think they care that you're mirroring their client that's already free to download?
No, they don't. They care about the private server that's taking money out of their pocket.
The problem is they can't do you for that, since it's not illegal. So they'll send you a big scary letter about all the things they COULD do you for if they wanted to, in order to scare you into shutting down the pserver.
Since the majority of private servers are run by kids (no offence guys!) TQ knows that when they send out these letters 90% of them will just crap their pants and shut everything down.
The only ones that remain are the ones that are smart enough not to break the law.
If you receive a letter from TQ about law violation, co-operate with it. Remove all offending elements of your website and inform them that you have complied. Request that they check the site and explicitly detail any remaining elements that they believe violate their legal rights so that you can remove them.
They can't demand that you stop providing an interface that allows players to connect modified clients to your server. They can't demand that you stop linking to another website which links to a torrent for downloading a modified client. They have no legal standing to do these things.
Remember kids - breaking the law is dumb. Don't do it :)
