Well if you have a good lawyer who has exp at internet law and crimes TQ would lose the court coz these files are not made by TQ they can court you only if you use them client but thats not a problem change some graphics till the client is +50% you'rs and you would also win and TQ is even to lasy to take legal action out of china or the states.
Yes, it'd be a waste and hassle to sue every private server out or will be out, but that still doesn't make it "legal" or "right" to make one.
