Thats kinda odd, since from what you are saying there there are no grounds for an arrest or conviction, but if he was doing somthing illegal he deserves the conviction for being stupid enough do it in the first place.

As for the OP personaly i find it quite disturbing you have have a crush on your cousin and advise you to look elsewere, as for the age problem if you are full into going for it, i'de wait a while and progress slowy.
