If I open a server for private use that does not allow "donations" or Silk to be purchased, then Joymax COULD file charges against me for using their copyrighted material. However, if I had the time and money for a lawyer, it would get thrown out of court since:
A.) I did not perform any illegal actions in obtaining the files.
B.) I did not use the files for a profit.
C.) Silkroad is technically a free game, so the revenue loss is a guess AT BEST.
No lawyer could prove that I was a result in lost profit from Joymax, UNLESS I SELL SILK. That's where private servers are going wrong. If you host a COMPLETELY free private server (free silk, etc) then you should be okay. If Joymax DOES sue you, then you must fight it in court. You also have to remember, private servers are most likely against the ToS set by Joymax. But if I do not accept the ToS, then they have nothing that will uphold in court.
There are a LOT of grey areas in American law, and some of it also depends on the judge. Most business cases such as this come down to statistics, copyrights, revenue loss and damages, etc.
