Other private servers used it already, plus they dont own the name, the whole SRO scene is lawless.

well, Ocean was hard to contact even when hosting ECSRO, I find it hard to contact him now
As you can see, TheMule(ZSZC GOneFishin) can be found here and is hard to contact, now imagine someone that is being missing for years

well, ECSRO's case is still "open" and using ECSRO's name could link you with ocean thus bringing you some law issues

since he left the SRO scene after ECSRO, I haven't heard his resolution or if he escaped in the end
I think, it is more probably he got involved with some other server(swSRO or ZSZC) secretly to get money and pay
